Terms of Use
1. Scope
These Terms of Use apply to all contracts and services between Fintrack GmbH, [Address], (hereinafter referred to as “Provider”) and its customers (hereinafter referred to as “Users”) in Germany.
2. Subject of the Agreement
The Provider offers the software “Fintrack” for managing financial assets. The exact scope of services is described in the service description available on the Provider’s website.
3. Conclusion of the Contract
The contract is established when the User registers and the Provider confirms the registration. By registering, the User agrees to these Terms of Use.
4. Usage Rights
The Provider grants the User a non-transferable, non-exclusive right to use the software during the term of the contract, as outlined in these Terms of Use. All other rights remain with the Provider.
5. User Obligations
• Users must keep access credentials confidential and must not share them with third parties.
• The User must not misuse the software, particularly by distributing unlawful content.
6. Fees
• The use of the software is subject to fees.
• The current prices are available on the Provider’s website.
• Payments are billed monthly in advance.
7. Liability
• The Provider is liable for intentional misconduct and gross negligence.
• In cases of slight negligence, the Provider is liable only for breaches of essential contractual obligations and limited to foreseeable damages.
• Liability for lost profits is excluded.
8. Data Protection
The Provider is committed to handling User data in accordance with the Privacy Policy and applicable data protection laws.
9. Term and Termination
• The contract is concluded for an indefinite period.
• Either party may terminate the contract with a notice period of four weeks to the end of the month.
• The right to terminate the contract for good cause without notice remains unaffected.
10. Changes to the Terms of Use
• The Provider reserves the right to amend these Terms of Use with future effect.
• Users will be informed about changes in a timely manner.
• If the User does not object to the changes within four weeks, the changes are deemed accepted.
11. Final Provisions
• German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
• The place of jurisdiction is the Provider’s registered office, provided the User is a merchant.
• Should any provision of these Terms of Use be invalid, the validity of the remaining provisions shall not be affected.
